Rape case: Man sentenced to 7 years RI

Mangaluru: A man has been sentenced to seven years rigorous imprisonment by the sixth district additional and sessions court on Tuesday for raping and cheating woman. The convict is identified as Umesh 34, a resident of Narimogaru.

The convict was employed at a hotel and befriended a 24-year-old woman who was his neighbour. Soon their friendship turned into a relationship. Umesh then reaped the woman by promising marriage and as a result, a baby girl was conceived by the woman on March 24th 2010. However, when she asked the convict to keep true his promise, he refused. Consequently, she filed a rape and cheating complaint with the police.

Umesh was booked under IPC 376 and 417 and the case was first filed at JMFC court in Puttur, but later transferred to the district court. Public prosecutor Judith O M Crasta argued on behalf of the prosecution and also submitted DNA samples which proved conclusively that the victim and the convict were indeed the biological parents of the infant.

The sentence

Investigating the case, Judge Sayeedunsia concluded that the Umesh was guilty of the charges and sentenced the convict under IPC 376 to 7 years of rigorous imprisonment (RI) and also fined Rs 50,000. Failing to pay the fine will attract an additional one-year normal incarceration. Rs 40,000 of the fine amount will be given to the victim.

The court also ordered the convict to pay an additional fine of Rs 1 lakh as compensation to the woman’s daughter which is to be deposited as a fixed deposit. The rape survivor is also eligible for monthly maintenance and compensation under the District Legal Authority Services, stated the Judge.
