Permit to Land Trades Solitaire building is legal: SC

Mangaluru: The building licence given to Land Trades Builders & Developers’ prestigious residential project ‘Solitaire’ by Mangaluru City Corporation (MCC) has been considered to be legal by the Supreme Court of India.

Earlier, some residents of the locality, aggrieved by the city corporation’s proposal for widening of one of the approach roads to Solitaire had approached the high court with a Public Interest Litigation (PIL) challenging the building licence given by MCC for Solitaire. The high court heard arguments from either parties and upheld the building licence given to Solitaire as legitimate.

Hence, the petitioners then appealed the high court order before the Supreme Court. However, the Supreme Court too has dismissed the PIL in its order dated July 19 and upheld the legality of building licence given by MCC for Solitaire. Besides, the Court has also directed the MCC to issue completion certificate for ‘Solitaire’ expeditiously in accordance with law. The court has also vacated its status quo on road widening by MCC of the approach road to Solitaire.

The city corporation also accepted the advice of the judges to address the grievances of the petitioners and has undertaken before the Supreme Court vide written affidavit to construct a retention wall for protecting the structures of three of the petitioners at the time of road widening. Thus, all the legal hurdles with regard to road widening have been overcome.

Solitaire- A benchmark for excellence

“Solitaire is a prestigious project where we have tried to set a new benchmark for excellence. Litigation regarding this project was pending before the courts for a long time. Now we are glad that our building licence for Solitaire has been legally validated by the highest court in the land. I am grateful to our customers and associates who have reposed their complete faith in me during this period,” said K Shrinath Hebbar, proprietor of Land Trades.

Solitaire is a green-friendly project with features like solar energy, rain water harvesting, waste segregation facility and in-house sewage treatment and recycle plant. It has been constructed in full compliance of the rules and regulations in force and is an ISO 9000:2015 firm with ‘DA2’ Real Estate Developer Rating from CRISIL.
